3. Data Collection on Our Website

Cookies

Our website uses cookies. Cookies do not harm your device and do not contain viruses. They serve to make our offer more user-friendly, effective, and secure. Cookies are small text files that are stored on your device and managed by your browser.

Most of the cookies we use are so-called “session cookies.” They are automatically deleted after your visit. Other cookies remain stored on your device until you delete them. These cookies allow us to recognize your browser the next time you visit.

You can set your browser to inform you about the setting of cookies, to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when the browser is closed. Disabling cookies may limit the functionality of this website.

Technically Necessary Cookies

Cookies that are required to carry out the electronic communication process or to provide certain functions you desire (e.g., to manage your cookie settings via Borlabs Cookie, language selection via WPML, or chatbot use) are used based on § 25 (2) No. 2 TDDDG. These cookies are technically necessary to provide our services and therefore do not require separate consent.

If personal data is processed through these cookies, this is done on the basis of Art. 6 (1) lit. b GDPR, as the processing is necessary for the performance of a contract or for the implementation of pre-contractual measures.

Cookies Based on Your Consent

We also use cookies for analysis purposes (e.g., Google Analytics), which are only set after your explicit consent via our consent tool. The legal basis for setting these cookies is § 25 (1) TDDDG. The subsequent processing of your personal data is carried out in accordance with Art. 6 (1) lit. a GDPR.

Further information on the cookies used, their duration, and managing your consent can be found in our consent tool: Borlabs Cookie Settings.

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The processing of this data is carried out to ensure the functionality of our website and to ensure system security. The legal basis is Art. 6 (1) lit. f GDPR, as we have a legitimate interest in the technical provision of the website and the prevention of misuse.

IP addresses are stored only for the duration of the session. Further storage does not occur unless required for security reasons.

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of the data entered into the contact form is therefore based exclusively on your consent (Art. 6 (1) lit. a GDPR). You can revoke this consent at any time. An informal email notification to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected.

The data you entered in the contact form remains with us until you request its deletion, revoke your consent to its storage, or the purpose for the data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – especially retention periods – remain unaffected.

4. Analytics Tools and Advertising

Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses cookies that collect information about your use of the website (including your IP address). These data are transferred to and stored on Google’s servers. The processing may also take place outside the EU legal area.

We have entered into a data processing agreement with Google and fully comply with the strict requirements of the GDPR. Google is committed to processing the data in accordance with applicable data protection regulations.

The storage of cookies and use of Google Analytics only takes place with your consent (Art. 6 (1) lit. a GDPR). You can revoke this consent at any time.

You can prevent the storage of cookies by adjusting your browser settings accordingly. Please note, however, that you may not be able to use all functions of this website in full. You can also prevent the collection of data generated by the cookie (including your IP address) by Google by downloading and installing the following browser plugin: Opt-Out Browser Plugin.

Objection to Data Collection

You can object to the collection of your data by Google Analytics at any time by clicking the following link. An opt-out cookie will be set that prevents the collection of your data on future visits to this website: Deactivate Google Analytics.

More information on how Google Analytics handles user data can be found in Google’s privacy policy.

Demographic Features in Google Analytics

This website uses the “demographic features” function of Google Analytics. This allows reports to be generated about age, gender, and interests of site visitors. These data cannot be attributed to any specific individual. You can disable this function at any time in your Google account’s ad settings or generally prevent the collection of your data by Google Analytics as described under “Objection to Data Collection.”

Google Analytics Remarketing

Our website uses the features of Google Analytics Remarketing in conjunction with the cross-device features of Google Ads and Google DoubleClick. This allows personalized, interest-based advertising messages to be shown on different devices (e.g., smartphone, tablet, PC) based on your previous usage behavior.

If you have consented to the use of personalized advertising, these data can be linked with your Google account so that the same personalized advertising messages can appear on all devices where you are signed in to your Google account.

To permanently object to cross-device remarketing, you can deactivate personalized advertising in your Google account: Google Ad Settings.

Google Ads and Google Conversion Tracking

This website uses Google Ads and within that, conversion tracking. When you click on a Google ad, a cookie is set that allows us to measure the effectiveness of our advertising activities. The information collected via the cookie allows us to determine the conversion rate but does not reveal the identity of the users.

The storage of conversion cookies is based on your consent (Art. 6 (1) lit. a GDPR). You can object to Google Conversion Tracking at any time by deactivating the cookie in your browser settings.

More information on Google Ads and Google Conversion Tracking can be found in Google’s privacy policy.

IP Anonymization

We have activated IP anonymization on this website. Your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google uses this information on behalf of the website operator to evaluate your use of the website and to compile reports.

5. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the provided email address and that you agree to receive the newsletter. No further data is collected, or it is only provided voluntarily. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered into the newsletter registration form is based exclusively on your consent (Art. 6 (1) lit. a GDPR). You can revoke the given consent to store the data, the email address, and its use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you have unsubscribed. Data that has been stored by us for other purposes (e.g., email addresses for member access) remains unaffected.

6. HubSpot

We use the services of HubSpot Inc., 25 First Street, Cambridge, MA 02141, USA, on our website and to process inquiries. Our contractual partner is HubSpot Ireland Limited, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland, with whom we have concluded a data processing agreement in accordance with Art. 28 GDPR. HubSpot processes personal data solely based on our instructions and in compliance with applicable legal requirements.

Processing is based on Art. 6 (1) lit. a GDPR (consent), provided such consent has been given, particularly for handling your inquiries, scheduling appointments, or analyzing the use of our website in order to optimize our services.

Personal data is stored only as long as necessary to fulfill the purposes mentioned above or until you revoke your consent or object to the processing. Once the purpose for storage no longer applies or statutory retention periods expire, the data will be deleted.

You have the right to object to the storage and use of your data at any time. Further information about data processing by HubSpot can be found in HubSpot’s privacy policy: https://legal.hubspot.com/privacy-policy

7. Chatbot

We offer a chatbot on our website that automatically responds to your service inquiries around the clock with suitable answers. The chatbot primarily assists you in making appointment requests or receiving offers.

The use of the chatbot is entirely voluntary and initiated by you. Data processing only begins once you start the chatbot. The legal basis for processing the data entered during the chat is Art. 6 (1) lit. b GDPR, as it is necessary to process your request and provide you with the requested information.

The chatbot itself does not request personal data and does not require it to function. Identification only occurs if you voluntarily enter personal details during the chat (e.g., name, phone number, email address).

To improve service quality, we log the automated chat dialogues. These logs are stored anonymously and partially reviewed manually to ensure the chatbot provides accurate and helpful answers. There is no further analysis or linkage with other data.

The logged chat histories are reviewed regularly and deleted after 31 days at the latest, unless legal retention requirements apply or further storage is necessary to assert, exercise, or defend legal claims.

Cookies for Chatbot Functionality
For operating the chatbot, we use necessary cookies to store the chat session ID, lead ID, and chat log ID. This enables continuation or resumption of the conversation. These cookies are essential for the chatbot’s functionality and therefore do not require separate consent under § 25 (2) TDDDG.

Your Rights
Even in connection with the use of the chatbot, you are entitled to the rights provided by the GDPR. These include, in particular, the right to access, rectify, delete, restrict processing, data portability, and the right to object to the processing of your personal data. Furthermore, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data is unlawful.
